Trans filmmaker Sam Feder's recent feature "Heightened Scrutiny" presents a moving two-part perspective – simultaneously an intimate profile of a key trans advocate and a critical examination of journalistic reporting about transgender issues.
This feature follows ACLU attorney Chase Strangio as he gets ready for legal presentations in the landmark highest court case the Skirmetti case. These arguments happened in late 2024, with the court ultimately ruling in support of the state's case, practically allowing restrictions on healthcare for trans youth to remain in effect across over twenty US territories.
We created Heightened Scrutiny in merely 16 months, stated Feder during a discussion. By contrast, my previous film Disclosure took me five years, so this was quite rushed. Our purpose was to raise discussion so people would know more about the case.
Although Feder presents a comprehensive examination of how mainstream publications have disseminated transphobic narratives, the film's greatest contribution may be its captivating depiction of Strangio. Normally a reserved lawyer in media settings, Strangio reveals his vulnerability throughout the production.
That was a significant challenge, to share aspects of my life to a filmmaker that I had worked hard to keep confidential, stated Strangio. Feder told me he wanted the next generation to know that we tried, to see what was done in support of these battles for our basic existence.
To support Strangio's narrative, Feder incorporates multiple transgender voices, including well-known figures from activism and the arts. This production also presents viewpoints from cisgender allies who critique how mainstream organizations have participated to damaging reporting of transgender individuals.
The perspective of trans youth central to the legal case is shown through a remarkable young activist named Mila. Audiences first see her fighting for her peers at a educational meeting, with later moments showing her protesting for transgender rights outside the highest court.
The documentary also includes poignant moments where Feder transcends the never-ending political struggle, such as scenes of Strangio vacationing in Italy and receiving a body art featuring lines from activist Pauli Murray's poem "Vision."
This body art sequence is among my favorites in the movie, stated Strangio. Being tattooed is nearly like a contemplative experience for me, to be totally engaged in my body and to think of it as a vehicle for things that are meaningful to me.
Feder's attention to lovingly showing Strangio adding to his body art underscores that Heightened Scrutiny is primarily about transgender physical selves – not just those of young people who face denial of their ability to live authentically in their own bodies, but also the physical forms of the numerous interviewees who are featured in the production.
I produce films with a purpose, and part of that is picking people who are exceptional and concise enough to sustain the camera, explained Feder. Whenever people ask me what they should wear for an interview, my reply is whatever makes you feel confident. That is essential to me – as transgender individuals, we face challenges so much with our appearance.Impact and Optimism
A key element that causes Feder's works stand out is his obvious talent for making his trans participants feel comfortable, recognized and admired. This methodology creates genuine chemistry between Feder and Strangio, allowing the director to realize his goal of presenting Strangio as a whole human being and leaving a document for coming generations of how determinedly he and fellow activists have campaigned for transgender rights.
I hope not people to find themselves in a state of incessant hopelessness because of what the law is denying us, stated Strangio. I want to be in a practice of using the law to minimize harm, but not to transform it into some type of conduit for our liberation aspirations. State bodies is not going to be the mirror through which we perceive ourselves.
